Lindsay Lohan will not be following Paris Hilton to jail; the 20 year old starlet won't be facing the felony grand theft charges that were filed against her for allegedly stealing a woman's clothing.

According to Los Angeles prosecutors, there just isn't enough evidence to charge Lindsay with the crime; the charges were dismissed after a woman claimed Lindsay stole a shirt and other clothing from her apartment while she was away.

One of the alleged stolen items was a plaid shirt, but this didn't match the one that Lindsay was seen wearing.

"The bottom line is that Lohan can't be shown to have been seen either taking or to have been later in possession of missing items and items she can be shown to have possessed were with [the housesitter's] permission," Deputy District Attorney Greg Somes stated in the rejection notice that dismissed the charges against Lohan, the AP reports.
